Zonbu Privacy Policy Last version: August 1st, 2007
PConRails LLC, editor of Zonbu, has created this privacy statement
("Statement") in order to demonstrate our commitment to customer privacy.
Privacy on our Site and in providing our services is of great importance to
us. Because we gather important information from our visitors and customers
(collectively, "Customers"), we have established this Statement as a means
to communicate our information gathering and dissemination practices.
We are dedicated to establishing a trusting relationship with our
Customers, based on respect for personal identity and information and by
promoting the use of fair information practices. This Statement covers
http://www.zonbu.com
(collectively, the "Site") and the Service. Because we want to demonstrate
our commitment to our Customers' privacy, we are disclosing:
a. What personally identifiable information we collect.
b. How we use the information, and with whom we share Customer information.
c. What choices are available to Customers regarding collection, use and
distribution of the information, and how Customers can correct any inaccuracy in the information.
d. What types of security procedures are in place to protect against the
loss, misuse or alteration of information under our control.
Disclaimer
We are only responsible, on a limited basis, for the information on our Site
and our proprietary applications provided to our Customers as part of the
Service. We are not responsible for information accessed through our Service
or open-source or third-party applications provided with the Service.
Regarding Children
We do not intentionally gather personal information about visitors who are
under the age of 18.
Information Collection
We collect information from our Customers through the following methods:
- Registration screens and online forms
- Automated means such as cookies and log files
- Customer communications
Registration
In order to use the Services, a Customer must first complete the
registration form. During registration, a Customer is required to give
contact information (such as name, email address and shipping address), and a unique identifier/password. This information is used to fill
Customer's orders. If we have trouble processing an order, the information
is used to contact the Customer.
When a Customer registers for the Service or when he expresses interest in
obtaining additional information, we may also ask for additional personal
information (such as title, department name and fax number) or additional
company information (such as annual revenues, number of employees, or
industry). Customers can opt out of providing this additional information by
not entering it when asked.
Cookies
We may receive data from our Customers as part of the communication
connection itself, that is, the standard electronic greeting between the
Customer's computer and our servers. This information often consists of
network routing (where the Customer came from), equipment information
(browser type), date and time. Our server will also query the Customer's
computer to see if there are "cookies" previously set by us to facilitate
log in or other site navigation procedures. Cookies are files that web
browsers place on a computer's hard drive and are used to tell us whether
Customers have visited the Site or used the Service previously.
Standing alone, cookies do not identify the Customer personally. They merely
recognize the Customer's browser. Unless the Customer chooses to identify
himself to us, either by responding to a promotional offer or opening an
account, he remains anonymous to us. The only personal information a cookie
can contain is information the Customer supplies. A cookie can't read data
off the Customer's hard disk or read cookie files created by other web
sites.
Cookies come in two flavors: session and persistent-based. Session cookies
exist only during an online session. They disappear from the Customer's
computer when he closes his browser software or turns off his computer.
Persistent cookies remain on the Customer's computer after he has closed his
browser or turned off his computer. They include such information as a
unique identifier for the Customer's browser.
We use session cookies to allow the system
to uniquely identify the Customer while he is logged in. This information
allows us to process our Customers' online transactions and requests, to
enhance security and/or to improve the functionality of the Site by avoiding
duplicate data entry, and facilitating navigation. Session cookies help us
make sure the Customer is who he says he is after he has logged in, and are
required in order to use the Service. We are especially
careful about the security and confidentiality of the information stored in
persistent cookies. For example, we do not store Customer IDs or passwords
in persistent cookies.
While we do not offer an opt-out on the Site for cookies, browsers provide
our Customers with information and control over cookies. If Customers
disable their web browser's ability to accept cookies, access to and usage
of the Service could be denied. We link the information we store
in cookies to any personally identifiable information you submit while on
our site.
Some of our business partners use cookies on our Site. However, we have no
access to or control over these cookies, once we have given permission for
them to set cookies for purposes pertinent to the provision of the Service.
Log Files
Our servers use log files to help diagnose technical problems, analyze
trends, administer the Site and the Service, track Customers' movement in
the aggregate, and gather broad demographic information for aggregate use.
In addition, we use log files to track data stored using the Service to the
appropriate Customer.
Surveys
Occasionally, we request information from Customers via surveys.
Participation in these surveys is completely voluntary, and the Customer
therefore has a choice whether or not to disclose this information. The
requested information typically includes contact information (such as name
and address), and demographic information (such as zip code). Survey
information will be used for purposes of monitoring or improving the use or
and satisfaction with the Service. Though we may use an intermediary to
conduct these surveys, we require that they not use Customers' personally
identifiable information for any secondary purposes.
Forums
If you use the forum on this Web site, you should be aware that any
personally identifiable information you submit there can be read, collected,
or used by other users of these forums, and could be used to send you
unsolicited messages. We are not responsible for the personally identifiable
information you choose to submit in our forums.
Links
Our Site and the Service contain links to other web sites. Please be aware
that we are not responsible for the privacy practices or content of such
other web sites. We encourage our Customers to be aware when they leave our
Site and to read the privacy statements of each web site that collects
personally identifiable information. This privacy statement applies solely
to information collected by our Site.
Tell-a-friend
If a Customer elects to use our referral service for informing a friend
about our Service, we ask them for the friend's name and email address. We
will automatically send the friend an email inviting them to visit
our Service. We store this information for the sole purpose of sending this
one-time email and tracking the success of our referral program. Your friend
may contact us at
http://www.zonbu.com/company/contact.htm or at
contact@zonbu.com to request that we
remove this information from our database.
Use of Information
Sharing
We are committed to protecting the privacy of our Customers. We will not,
under any circumstances, rent, sell, or give away our Customers' personal
information or Data, nor do we trade or exchange mailing lists with any
other organization. We also will not monitor, edit, or disclose the contents
of a Customer's personal information or Data. Notwithstanding the foregoing,
we may disclose a Customer's personal information or Data to third parties
if we believe that such action is necessary to (1) enforce the terms of the Zonbu Terms of Use, (2) comply with applicable law, (3) comply with a
current judicial proceeding, a court order or other legal process, (4)
protect and defend our rights or property, or (5) act under exigent
circumstances to protect the personal safety of our Customers or the public.
Profile
We store information that we collect through cookies and log files to create
a profile of our Customers. A profile is stored information that we keep on
Customers that details their viewing preferences and use of the Service.
Such information is tied to the Customer's personally identifiable
information to improve the content of the Site and the Service for the
Customer. We do not share personally identifiable elements of a Customer's
profile with other third parties.
Communication from the Service
We will not send our Customers excessive amounts of email or other
communications. However, we might, from time to time, send to our Customers
emails containing the following types of information: notifications
concerning the status or expiration of the Customer's account; activity
status reports; service and software upgrade notices; Service usage tips,
notices concerning new Service features and the pricing of our Services (but
not those of any other party); and requests for feedback on the Customer's
use of the Service.
Customers are invited to receive email communications, such as a newsletter,
by providing an email address. Customer email addresses and any personal
information will not be distributed or shared with third parties.
Customers may opt-out of receiving many of such notices. Please see the
Opt-out section below.
Service Announcements
On rare occasions, it is necessary to send out a service-related
announcement. For instance, if our service is temporarily suspended for
maintenance, we might send Customers an email notifying them of the issue.
Generally, Customers may not opt-out of these communications. However, these
communications are not promotional in nature. If you do not wish to receive
them, you have the option to deactivate your account by sending us an email
at contact@zonbu.com.
Customer Service
We communicate with Customers on a regular basis to provide requested
support services and regarding issues relating to their accounts. We make
such communications via email or phone. Individual records and Data may at
times be viewed or accessed for the purpose of resolving a technical
problem, a support issue, or a suspected violation of the Terms of Use.
Business Transitions
In the event we go through a business transition, such as a merger, being
acquired by another company, or selling a portion of our assets, Customers'
personal information will, in most instances, be part of the assets
transferred. Customers will be notified prior to a change of ownership or
control of their personal information. If, as a result of the business
transition, the Customers' personally identifiable information will be used
in a manner different from that stated at the time of collection, they will
be given a choice not to have their information used in this different
manner, as described in the Notification of Changes section below.
Notification of Changes
If we make any material changes to this policy, we will notify by email
or by means of a notice on this page, so that our Customers will always have access to a
statement of what information we collect, how we use it, and under what
circumstances, if any, we disclose it. Therefore, we encourage our Customers
to check this Statement whenever they use the Service to see if it has been
updated since their last visit.
Customers will have a choice as to whether or not we use their information
in this different manner. However, if Customers have opted out of all
communication with the service, or deleted/deactivated their account, then
they will not be contacted, nor will their personal information be used in
this new manner.
Choice and Information Management
Opt-out
We provide our Customers the opportunity to "opt-out" of having their
personally identifiable information used for certain purposes, when we ask
for this information. For example, if Customers do not wish to receive any
additional marketing material from us, you can indicate your preference on
the order form. If Customers no longer wish to receive our newsletter and
promotional communications, Customers may opt-out of receiving them by
following the instructions included in each newsletter or communication or
by emailing us at contact@zonbu.com.
We also offer an opportunity to opt-out of certain communications on
http://www.zonbu.com/getzonbu/,
or you may contact us at
contact@zonbu.com to opt-out.
You will be notified when your personal information is collected by any
third party that is not our agent/service provider, so you can make an
informed choice as to whether or not to share your information with that
party.
Managing Personal Information
If a Customer's personally identifiable information changes (such as zip
code, phone, email or postal address), or if a Customer no longer desires to
use our Service, we provide a way to correct, update or delete/deactivate
Customers' personally identifiable information. This can be done at
the profile page of the Zonbu service by visiting http://www.zonbu.com/getzonbu/,
or contacting us at contact@zonbu.com
or mailing us at Zonbu - PConRails, 1618 El Camino Real, Menlo Park, CA 94025.
Security
When our Site is accessed using the standard browsers (including but not
limited to Internet Explorer, Firefox...), Secure Socket Layer (SSL) technology
protects information using both server authentication and data encryption to
help ensure that Data is safe, secure, and available only to the Customer.
Data stored through the Service is also encrypted using a 128-bit encryption
technology though file name is not encrypted. These safeguards help prevent unauthorized access,
maintain data accuracy, and ensure the appropriate use of Data.
In addition, all of our Customers' information, not just the sensitive
information mentioned above, is restricted in our offices. Only employees
who need the information to perform a specific job (for example a customer service representative) are granted access to
personally identifiable information.
We contract with a third party to provide and manage the servers that are
required to provide the Service and on which Customers' personal information
and Data is stored. The third-party provider has ensured us that their
service is hosted in a secure server environment that uses a firewall and
other advanced technology to prevent interference or access from outside
intruders. The privacy policy of our third-party provider can be viewed at
http://www.amazonaws.com.
Account information and access to our Service is accessible only through the
use of an individual Customer ID and password. To protect the
confidentiality of personal information, the Customer must keep his password
confidential and not disclose it to any other person. The Customer is
responsible for all uses of our Site and Service by any person using his
account Customer ID and password. Customers should advise us immediately if
they believe their account Customer ID and password have been misused.
While we have taken efforts to guard our Customers' personal information, we
cannot ensure or guarantee that such information will not be disclosed or
accessed by accidental circumstances or by the unauthorized acts of others.
Each Customer transmits such information to us and uses the Service at his
own risk.
Spam and Junk Emails
We have a zero tolerance policy for abuse. While we cannot be responsible
for external communications received through use of the Service, it is our
intention to use all legally available means to prevent distribution and
receipt of unsolicited commercial advertisements through the service.
International Users
Please note that Customer personal information will be stored and processed
on computers in the United States. The laws on holding personal data in the
United States may be less stringent than the laws of other countries. If a
Customer objects to his personal information being transferred or used as
described in this Statement, the Customer should not register for the
Service.
